El presente artículo se propone analizar la contraposición entre ciertos supuestos básicos del liberalismo, aún en sus versiones más igualitarias, y aquello que consideramos es un requisito para el desarrollo de la democracia. Principalmente se cuestionará la suposición de egoísmo que atraviesa la obra de John Rawls, quien cuando procura ajustar su propuesta de justicia distributiva al realismo psicológico, es cuando más se aferra al pesimismo antropológico que caracterizara al liberalismo desde su emergencia. Sostendremos pues, que la suposición de egoísmo (...) que Rawls es incapaz de dejar de lado, es una justificación nada neutral de la propiedad privada y del mercado, a la que el liberalismo ha recurrido aún de espaldas a la complejidad que es propia de las relaciones humanas efectivas, es decir, cuando el argumento liberal se dice más realista, es cuando es más ideológico. La democracia se funda, por el contrario, en la posibilidad de matizar dicho egoísmo y por ende, mientras los argumentos liberales permanezcan ciegos a ello, no podrán constituir una defensa efectiva de la democracia, sino por el contrario, serán una amenaza para las bases materiales de ésta. En este trabajo proponemos una lectura de la filosofía política de Smith, a partir de su teoría de la obligación política, en tanto crítica del contractualismo. El autor rechaza la hipótesis del estado de naturaleza y el consentimiento de los individuos, proponiendo, en cambio, una teoría basada en la opinión, pero, sobre todo, en la ilusión de que la sociedad comercial nos conducirá a la felicidad. Mientras Carole Pateman (1988) afirma que «para las feministas la democracia no ha existido jamás», Julieta Kirkwood (1986) sostiene que «no hay democracia sin feminismo». Ambas aluden a la deuda del ideal democrático con la emancipación de las mujeres, e incluso a la función estructural de la exclusión de las mujeres en la democracia liberal. A partir de los encuentros y desencuentros entre democracia y feminismo, el presente artículo pretende ofrecer una definición de la democracia feminista que vaya más allá (...) de la inclusión a través de la acción afirmativa, abordando las tensiones que esta genera en el debate feminista de las últimas décadas y los nuevos desafíos en torno a las políticas de redistribución y de reconocimiento. ¿Es posible superar la opresión y la dominación a partir de políticas centradas en el interés de grupo? ¿Cómo se define ese interés sin esencializar la diferencia? El primer objetivo del presente artículo es reconstruir el concepto de obligación política en Hume a partir de lo expuesto en el _Tratado de la naturaleza humana_ y en algunos de sus ensayos políticos. Hume es crítico del contractualismo y su idea del consentimiento como fundamento de la legitimidad de la autoridad, proponiendo en su lugar lo que llama “aquiescencia precaria”. El segundo objetivo es analizar el alcance del escepticismo humeano respecto de la obligación política y verificar si se extiende (...) a la obligación de cumplir las reglas de justicia. Para ello analizaremos la figura del _sensible knave_ introducida en la Investigación de los principios de la moral, y la respuesta que Hume le da a quienes se resisten a cumplir las reglas. Concluiremos que el escepticismo humeano que se ve reflejado en su comprensión de la obligación política, afecta también a su respuesta a los potenciales infractores de las reglas, sin embargo, más que un fallo en el argumento de Hume sería una ventaja para pensar la política más allá de los dogmatismos. This article argues that Schmitt’s concept of sovereignty and Gramsci’s notion of hegemony represent two distinct variations on a single theme, namely the idea of the political as the original instituting moment of society. Both Schmitt and Gramsci focused on the sources, conditions, content, and scope of the originating power of a collective will. While the former located it in the constituent power of the sovereign people, the latter placed it in the popular-national will of the modern hegemon. Both thinkers (...) explored the complex and perplexing relationship between radical founding acts and modern democratic politics in a secular age, that is of democratic legitimacy, where with the entrance of the masses into the political sphere, the references to ultimate foundation s of authority and to an extra-social source of political power had begun to appear more dubious than ever. The last section of the article develops a notion of hegemonic sovereignty defined as an expansive and positing democratic constituent prince, aiming, through founding, total decisions, at the overall, radical, explicit, and lucid institution of society. The article briefly shows how the concept of hegemonic sovereignty can solve some problems pertaining to Schmitt’s notion of sovereignty and to Gramsci’s theory of hegemony. In so doing, the article seeks to establish the mutually reinforcing qualities of the two concepts. (shrink)

ABSTRACT In the following text we aim to present a proposal of interpretation of Hobbes's work from sociobiology viewpoint. Despite the fact it may strike some at first as an anachronism or straightforward wrong, reading the philosopher of Mamelsbury from a sociobiological perspective, can shed light on some particular aspects of his argument, particularly those referring to the construction of human nature and its influence on the modulation of the state of nature and on the justification of authority and political (...) obligation. So, Hobbes proceeds as a sociobiologist since he offers us a tale about the emergence of morality from where it didn't exist before and moves from there to a specific understanding of political authority. RESUMO No texto a seguir, pretendemos apresentar uma proposta de interpretação da obra de Hobbes a partir de sociobiologia. Apesar de poder chocar alguns em primeiro lugar como um anacronismo ou errado, ler o filósofo da Mamelsbury a partir de uma perspectiva sociobiológica pode lançar luz sobre alguns aspectos particulares do seu argumento, em especial os referentes à construção da natureza humana e sua influência sobre a modulação do estado de natureza e sobre a justificação da autoridade e obrigação política. Portanto, Hobbes procede como um sociobiólogo, já que ele nos oferece um conto sobre o surgimento da moralidade de onde ela não existia antes e se move de lá para uma compreensão específica da autoridade política. This article aims at two objectives, the first is to prove the insufficiency of the Kantian ethics matrix to give an account of vulnerability and precarity that are part of human existence. We will show how the “losing” side of ethical theories of modernity, offer a richer frame to asses human interdependency. Our second objective is to pose the hypothesis about a relation between those discourses of freedom as autonomy and the negation of human vulnerability and hence of the relegation (...) or subalterization of the ethical arguments based on care. En el artículo analizaremos el problema de la obligación política en Hobbes, entendiendo esta como una compulsión de carácter moral a la obediencia a las leyes, por oposición a un cálculo meramente prudencial. Contra la lectura tradicional que considera a Hobbes un teórico del consentimiento, afirmaremos que el consentimiento juega un rol secundario para la obligación y que esta se sostiene aparentemente en las leyes de naturaleza como preceptos de razón prudencial, orientados a la autopreservación. Explicaremos que la teoría de (...) Hobbes justifica más bien lo que Carole Pateman denomina una teoría de la “obediencia política”, fallando en justificar la obligación. (shrink)

This chapter reviews the literature on experimental political philosophy. Much of the literature considers individuals’ intuitions about distributive justice, retributive justice, and key concepts such as the doing/allowing distinction. The chapter argues that although there is relatively little experimental political philosophy proper, there are many avenues for future research. It presumes some familiarity with political philosophy, but its main aim is not to explain the relevance of studies to particular debates. The chapter provides an overview of interesting empirical results that (...) may be of some broad interest and suggests that there is reason for those interested in experimental political philosophy to do new kinds of empirical work and employ new methods from many disciplines. Experimental philosophy need not model itself primarily on the discipline of psychology. There are many useful methods available for answering important questions experimental philosophers might want to address in these other disciplines. (shrink)

Hermeneutical injustice, as a species of epistemic injustice, is when members of marginalized groups are unable to make their experiences communicatively intelligible due to a deficiency in collective hermeneutical resources, where this deficiency is traditionally interpreted as a lack of concepts. Against this understanding, this paper argues that even if adequate concepts that describe marginalized groups’ experiences are available within the collective hermeneutical resources, hermeneutical injustice can persist. This paper offers an analysis of how this can happen by introducing the (...) notion of hermeneutical excess: the introduction of additional concepts into collective hermeneutical resources that function to obscure agents’ understanding of the lived experiences of marginalized groups. The injustice of hermeneutical excesses happens not due to hermeneutical marginalization (the exclusion of members of marginalized groups from the construction of hermeneutical resources), but rather hermeneutical domination: when members of dominant groups have been inappropriately included in the construction of hermeneutical resources. By taking as exemplary cases the concepts of “reverse racism” and “non-consensual sex” this paper shows how such excesses are introduced as a kind of defensive strategy used by dominant ideologies precisely when progress with social justice is made. This article proposes that the meditation on contemporary violence, in the Eduardo Nicol’s works, is part of a broad process of philosophical reflection of three decades, which questions the present and the future of humanity. Violence, for Nicol, is the display of a special rationality, born in Modernity, which he calls “force majeure reason” (razón de fuerza mayor) that is a change of life regime in the contemporary human being, sometimes to the basic need for survival, utility and a network (...) of forcedness that reduces possibilities and freedom. In this way, the article traces in Nicol´s work the conformation —from the notion, to the idea and the conceptual framework— of violence as a disposition, act and system. Political regulation, hate and intersubjective violence, hostility and war in a global world are the focus of this collaboration. Este artículo propone que la meditación sobre la violencia contemporánea, en la obra de Eduardo Nicol, está inscrita en un amplio proceso de reflexión filosófica de tres décadas, que interroga sobre el presente y el porvenir de la humanidad. La violencia, para Nicol, es el despliegue de una racionalidad peculiar —gestada en la Modernidad— por disolvente de la verdad, a la cual él llama “razón de fuerza mayor”. De este modo, el artículo rastrea en la obra de este filósofo la conformación —desde la noción, hasta la idea y marco conceptual— de la violencia en tanto disposición, acto y sistema. This study aims to investigate the relationship between job burnout and employee performance in the feed industry during the ASF outbreak. Further, the researchers employed a descriptive-correlational research design in order to analyze the acquired data and produce pertinent findings. Thus, the researchers gathered data from one hundred two (102) feed industry employees. The Maslach Burnout Inventory (MBI) and Individual Work Performance Questionnaire (IWPQ) were employed to ascertain the extent of job burnout experienced by the respondents and evaluate employee performance, (...) respectively. Based on the statistical analysis, there is a significant relationship between job burnout and employee performance. Moreover, the study's findings were thoroughly analyzed and discussed. (shrink)

The question of how we should engage with a philosopher’s racial thought is of particular importance when considering Kant, who can be viewed as particularly representative of Enlightenment philosophy. In this article I argue that we should take a stance of deep acknowledgment when considering Kant’s work both inside and outside the classroom. Taking a stance of deep acknowledgment should be understood as 1) taking Kant’s racial thought to be reflective of his moral character, 2) Kant being accountable for his (...) racial thought and 3) being willing to consider the possibility that Kant’s racial thought is consistent with and inextricable from his moral philosophy. Alternative forms of engaging with Kant’s racial work have either moral or pedagogical failings, which range from simply teaching the history of philosophy uncritically to outright deception. A stance of deep acknowledgement will allow philosophers to understand how Kant’s racial thought interacts with his moral philosophy and allow instructors to teach philosophy in a historically contextualized approach so as to not alienate students whose demographic was disparaged by Kant. Deliberative democracy is an embattled political project. It is accused of political naiveté for it only talks about power without taking power. Others, meanwhile, take issue with deliberative democracy’s dominance in the field of democratic theory and practice. An industry of consultants, facilitators, and experts of deliberative forums has grown over the past decades, suggesting that the field has benefited from a broken political system. This book is inspired by these accusations. It argues that deliberative democracy’s tense relationship with power (...) is not a pathology but constitutive of deliberative practice. Deliberative democracy gains relevance when it navigates complex relations of power in modern societies, learns from its mistakes, remains epistemically humble but not politically meek. These arguments are situated in three facets of deliberative democracy—norms, forums, and systems—and concludes by applying these ideas to three of the most pressing issues in contemporary times—post-truth politics, populism, and illiberalism. “Ghosting”, the act of ceasing all communication with someone with whom you have been romantically involved, is now a normal part of modern dating. The common moral judgment of ghosting is negative, that it is a bad behavior that treats people disrespectfully, and trains up a lack of empathy and accountability in those who engage in it (Abad-Santos 2017; Guilluame 2016; G 2017; Smith 2017). These behaviors and traits are at least morally undesirable if not outright wrong, and so, consequently, (...) it isn’t permissible for anyone to ghost. But is this the whole story to be told about ghosting? In this paper, I offer quite different responses to these two questions about ghosting. Focusing here on gender identity, I claim that it is permissible for women to ghost men. This is because, I contend, women’s practices of ghosting are a justified response to men’s practices of misogyny within the context of heterosexual dating. As such, I argue that contrary to the common perception that ghosting is rude or disrespectful, it rather serves a self-protective function for women and can at times qualify as an act of resistance against women’s oppression. In this way, not only is ghosting done by women minimally permissible, it might even be considered laudable. (shrink)

In the current U.S. context, we are facing a Constitutional crisis with frequent government shutdowns and new policy debates surrounding immigration, climate change, budgeting practices, and the balance of power. With competing interests, unclear policy, and inconsistent leadership directives, the question becomes: How do contemporary bureaucrats make sense of this ethically turbulent environment? The denial of voting rights to certain types of persons continues to be a moral problem of practical significance. The disenfranchisement of persons with mental impairments, minors, noncitizen residents, nonresident citizens, and criminal offenders is a matter of controversy. This book makes a contribution to this largely neglected yet key topic.

This book presents a multi-faceted reconsideration of dominant approaches to violence and social critique. Its unifying thread is a dedication to overcoming violence and domination on a scale larger than individual micro-resistances, even as many contributors reject programmatic thought and “self-possessed” political action.

Logics—that is to say logical systems—are generally conceived of as describing the logical forms of arguments as well as endorsing cer- tain principles or rules of inference specified in terms of these forms. From this perspective, a correct logic is a system which captures only (and perhaps all) of the correct principles, and good—i.e. logical— reasoning is reasoning which at the level of logical form conforms to the principles of a correct logic. In contrast, as logical particularists we reject the (...) idea that logical validity is a property of logical forms or schema, and instead take validity to be a property of particular in- ferences. In this paper we describe and defend this radically different approach to validity, and explore the particularist understanding of the relationship between logical systems and logical reasoning. A heterogeneous survey sample of for-profit, non-profit and government employees revealed that organizational factors but not personal characteristics were significant antecedents of misconduct and job satisfaction. Formal organizational compliance practices and ethical climate were independent predictors of misconduct, and compliance practices also moderated the relationship between ethical climate and misconduct, as well as between pressure to compromise ethical standards and misconduct. Misconduct was not predicted by level of moral reasoning, age, sex, ethnicity, job status, or size and type of organization. (...) Demographic variables predicted job satisfaction and organizational variables added significant incremental variance. Results suggest the importance of promoting a moral organization through the words and actions of senior managers and supervisors, independent of formal mechanisms such as codes of conduct. (shrink)

We bring together recent discussions on data capitalism and biocapitalization by studying value flows in consumer genomics firms—an industry at the intersection between health care and technology realms. Consumer genomics companies market genomic testing services to consumers as a source of fun, altruism, belonging and knowledge. But by maintaining a multisided or platform business model, these firms also engage in digital capitalism, creating financial profit from data brokerage. This is a precarious balance to strike: If these companies’ business models consist (...) of assetizing the pool of genomic data that they assemble, then part of their work has to revolve around obscuring to consumers any uncertainties that would potentially impinge on these processes of assemblage. We reflect on the nature of these practices and the market relationships that enable them, and we relate this reflection to debates around alternative market arrangements that would potentially mitigate the extractive tendencies of these and other digital health firms. Multiple studies have been performed to identify the most common ethical dilemmas encountered by ethics consultation services. However, limited data exists comparing the content of ethics consultations requested by specific hospital specialties. It remains unclear whether the scope of ethical dilemmas prompting an ethics consultation differ between specialties and if there are types of ethics consultations that are more or less frequently called based on the specialty initiating the ethics consult. This study retrospectively assessed the incidence and content of ethics (...) consultations called by surgical vs. non-surgical specialties between January 1, 2013 to December 31, 2018 using our RedCap Database and information collected through the EMR via our Clinical and Translational Science Center. 548 total ethics consultations were analyzed. Our results demonstrate that more surgical consults originated from the ICU, as opposed to lower acuity units, and surgical patients were more likely to have a DNR in place. Surgical specialties were more likely to call about issues relating to withholding/withdrawing life-sustaining treatment, while non-surgical specialties were more likely to call about issues related to discharge planning. There appear to be morally relevant differences between consults classified as the “same” that are not entirely captured by the usual ethics consultations classification system. In conclusion, this study highlights the unique ethical issues experienced by surgical vs. non-surgical specialties. Ultimately, our data can help ethics consultation services determine how best to educate various hospital specialties to approach ethical issues commonly experienced within their field. (shrink)

We demonstrate in two experiments that real and imagined body movements appropriate to metaphorical phrases facilitate people's immediate comprehension of these phrases. Participants first learned to make different body movements given specific cues. In two reading time studies, people were faster to understand a metaphorical phrase, such as push the argument, when they had previously just made an appropriate body action (e.g., a push movement) (Experiment 1), or imagined making a specific body movement (Experiment 2), than when they first made (...) a mismatching body action (e.g., a chewing movement) or no movement. These findings support the idea that appropriate body action, or even imagined action, enhances people's embodied, metaphorical construal of abstract concepts that are referred to in metaphorical phrases. Luck egalitarians think that considerations of responsibility can excuse departures from strict equality. However critics argue that allowing responsibility to play this role has objectionably harsh consequences. Luck egalitarians usually respond either by explaining why that harshness is not excessive, or by identifying allegedly legitimate exclusions from the default responsibility-tracking rule to tone down that harshness. And in response, critics respectively deny that this harshness is not excessive, or they argue that those exclusions would be ineffective or lacking in justification. (...) Rather than taking sides, after criticizing both positions I also argue that this way of carrying on the debate – i.e. as a debate about whether the harsh demands of responsibility outweigh other considerations, and about whether exclusions to responsibility-tracking would be effective and/or justified – is deeply problematic. On my account, the demands of responsibility do not – in fact, they can not – conflict with the demands of other normative considerations, because responsibility only provides a formal structure within which those other considerations determine how people may be treated, but it does not generate its own practical demands. In this paper, I draw on the principles of Aristotelian ethics, the work of modern virtue ethicists, and previous feminist critiques of purity balls to interrogate the effects of this practice on moral development. I argue that purity balls discourage young women from making autonomous, informed, and virtuously motivated decisions regarding their sexuality. While most critiques of purity balls are rooted in the explicitly patriarchal structure of these events, my analysis emphasizes the negative impact they have on moral agency. This study investigated the roles of problem structure and strategy use in problem encoding. Fourth‐grade students solved and explained a set of typical addition problems (e.g., 5 + 4 + 9 + 5 = _) and mathematical equivalence problems (e.g., 4 + 3 + 6 = 4 + _ or 6 + 4 + 5 = _ + 5). Next, they completed an encoding task in which they reconstructed addition and equivalence problems after viewing each for 5 s. Equivalence problems (...) of the form 4 + 3 + 6 = 4 + _ overlap with a perceptual pattern found in traditional arithmetic problems (i.e., answer blank in final position), and students' encoding was poorest on problems of this type. Individual differences in encoding the equivalence problems were related to variations in strategy use. Some students solved blank‐final equivalence problems using the standard arithmetic strategy of performing all given operations on all given numbers. These students made more errors in encoding problem structure, but fewer errors in encoding the numbers, than did students who solved the problems using correct or other incorrect strategies. Moreover, students who expressed many strategies for solving the blank‐final equivalence problems made fewer errors in encoding problem structure, but more errors in encoding the numbers, than did students who expressed only a single strategy. Results highlight that encoding is intended to guide action and that prior experience can simultaneously facilitate and interfere with accurate encoding. (shrink)
